The Microsoft ruling was a temporary victory for the software giant, but it was a great loss for capitalism and freedom. Microsoft obviously wins because it does not have to break up its company at the point of a government gun. There is a cause to celebrate, but it is enormously sobering that Microsoft ever faced such a threat. Although Judge Thomas Penfield Jackson -- who arbitrarily proposed the breakup of Microsoft in the first place -- is an unusually biased and brazen judge, as the appeals court found, there's still no telling what may lie ahead for Microsoft if it continues to beat the competition. The appeals court has wrongly upheld the claim that Microsoft is a monopolist that illegally and "unreasonably" stifles competition. No such thing is true. Microsoft pleases the great majority of consumers in the computer marketplace. These consumers happily and voluntarily buy their products. This is no offense. On the contrary: It is a success and a virtue. It is precisely for this virtue that Microsoft is being sued. Yet this is the whole non-objective nature of the antitrust laws. The only thing you can be sure of is that if you succeed in a big way, you will be punished. Now it's time to recognize that the very arbitrary foundation of the anti-trust law itself is likewise a disgrace, and the law should be repealed.
